Engero Terms and Conditions

Please read these Terms and Conditions (Terms) carefully before using Engero (engero.art). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the platform.
1. What Engero Is
Engero is a platform that helps artists, creative professionals, organisers, and audiences:
- create and manage profiles
- list bookable service packages
- discover and connect with one another
- coordinate booking requests
- generate booking agreement documents based on user-provided information
Engero is a platform provider only. Engero is not:
- a talent agency
- an employer of artists
- a party to any booking, performance, sale, or payment agreement between users
Any agreement made between an artist and a client is a separate agreement between those users only.
2. Who Can Use Engero
You may use Engero only if:
- you are at least 18 years old, or
- you are 13 to 17 years old and have the consent of a parent or legal guardian
By using Engero, you confirm that:
- all information you provide is true, complete, and accurate
- you will keep your account details secure
- you are responsible for all activity under your account
- you will use the platform only for lawful purposes
If we reasonably believe that any account information is false or that a user does not meet these requirements, we may suspend or close the account.
3. Account Types
Engero supports two main account types:
- Artist accounts: for individuals or groups offering creative services, performances, or products for booking or purchase
- Audience/Organiser accounts: for individuals or organisations seeking to discover, book, or purchase from artists
You must use the account type that matches your actual role and identity.
You may not create misleading accounts, impersonate another person, or use false identity information.
4. Account Information
When creating an account, you may be asked to provide:
- your legal name, for contract generation and account verification
- your display name, which may appear publicly on your profile
- contact details
- profile information and content
- booking and package information
Your legal name will not be shown publicly unless required by law or necessary for the operation of a booking agreement.
You are responsible for keeping your account information up to date.
5. Packages and Bookings
Artists may create service packages that describe:
- what they offer
- pricing
- availability
- location or travel requirements
- event or delivery conditions
- other booking terms
When a client requests a booking, Engero may help with:
- collecting booking details
- generating a booking agreement document
- sharing the request with the relevant artist
- supporting the booking coordination process
Engero does not guarantee that any booking request will be accepted, fulfilled, or completed.
The agreement to perform, deliver, or pay is made directly between the artist and the client.
Important: Artists are responsible for making sure their package terms are accurate, lawful, and suitable for the service they offer.
6. Payments
Engero does not currently process, hold, or guarantee payments between artists and clients.
Payment is arranged directly between the artist and the client using a method they both agree on, such as:
- mobile money
- bank transfer
- cash
- other direct payment methods
Because Engero is not a party to payment transactions:
- Engero is not responsible for non-payment, late payment, partial payment, or payment disputes
- Engero does not issue refunds for payments made directly between users
- users are responsible for agreeing payment amount, timing, method, and any deposit requirements before or during the booking process
Important: Users should confirm payment terms in writing before the booking is confirmed.
If Engero introduces payment protection, escrow, or other payment services in the future, those services will be governed by additional terms.
7. Contracts and Booking Agreements
Engero may generate booking agreement documents based on information provided by the artist and client.
These documents are provided for convenience only and are a starting point, not legal advice.
By using the platform, you acknowledge that:
- Engero is not a law firm
- Engero does not provide legal advice
- generated agreements should be reviewed by the parties before signing
- the parties are responsible for signing and executing any agreement
- Engero does not witness, verify, or enforce signed agreements
The enforceability of any booking agreement depends on the applicable law and the facts of the specific transaction.
If there is any conflict between a generated agreement and applicable law, applicable law will prevail.
Recommendation: For high-value, international, or complex bookings, parties should seek independent legal advice.
8. Intellectual Property
Artists retain ownership of their creative work, performances, and content they upload to Engero, unless they agree otherwise in writing.
By uploading content such as photos, videos, audio, portfolio items, bios, and profile text, you grant Engero a:
- non-exclusive
- worldwide
- royalty-free
- limited licence
This licence allows Engero to host, display, reproduce, and distribute that content only as needed to:
- operate the platform
- display your profile
- promote your listings within the platform
You confirm that:
- you own or have permission to use all content you upload
- you have permission from any person shown in the content where required
- your content does not infringe another person's rights
Engero's own branding, design, software, graphics, and platform code belong to Engero and may not be copied, reused, or distributed without written permission.
When your account is deleted or content is removed, Engero may retain backup or archival copies for legal, security, or operational reasons for a reasonable period, unless a shorter period is required by law.
9. AI-Assisted Features
Engero may offer optional AI-assisted tools, such as:
- profile bio generation
- package description drafting
- content improvement suggestions
- contract drafting and review
When you use these tools:
- the information you enter may be sent to third-party AI service providers for processing
- you should not enter sensitive information unless it is necessary and you understand how it may be used
- AI-generated content is provided as a draft or suggestion only
- you are responsible for reviewing, editing, and confirming all AI-generated content before using or publishing it
Engero aims to reduce the generation of false or unsupported claims, including fabricated credentials or pricing suggestions. However, Engero does not guarantee that AI-generated content will always be accurate, complete, or suitable for publication.
You must not publish AI-generated content that is false, misleading, unlawful, or unverified.
Use of AI-assisted features is also subject to our Privacy Policy, which explains how personal data is handled.
10. Prohibited Conduct
You agree not to:
- provide false or misleading information on your profile or in your bookings
- fabricate credentials, achievements, reviews, or experience
- use Engero to facilitate illegal activity
- harass, threaten, defraud, or impersonate another person
- abuse, disrupt, or interfere with the platform or other users
- attempt to reverse-engineer, copy, or bypass platform features
- scrape, extract, or collect platform data without permission
- upload content that infringes intellectual property or privacy rights
- post content that is fraudulent, abusive, hateful, or otherwise unlawful
We may investigate violations and take action as described below.
11. Content Moderation, Suspension, and Termination
Engero may review, remove, restrict, suspend, or terminate accounts or content if we reasonably believe that:
- these Terms have been violated
- a user has misrepresented themselves
- content is unlawful, harmful, or misleading
- a user poses a risk to other users or the platform
- required verification or consent is missing
Where reasonably possible, we may notify you before taking action. In urgent or serious cases, we may act immediately.
If your account is suspended or terminated, you may contact us at the email address below to request a review.
Important: We may remove content or suspend access to protect users, comply with the law, or protect the platform's security and integrity.
12. Disclaimers and Limitation of Liability
Engero is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by applicable law.
We do not guarantee that:
- the platform will always be available, secure, or error-free
- any user will respond to a booking request
- any booking will be completed
- any content generated by the platform will be accurate or suitable for your needs
To the maximum extent permitted by applicable law, Engero and its operators are not liable for:
- disputes between artists and clients
- non-payment or payment issues
- performance quality or booking outcomes
- losses caused by reliance on AI-generated content
- indirect, incidental, special, or consequential damages arising from use of the platform
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.
13. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will notify users by:
- email, or
- a notice on the platform
Your continued use of Engero after the updated Terms take effect means you accept the changes.
The date at the top of these Terms shows when they were last updated.
14. Privacy and Data Use
Your use of Engero is also subject to our Privacy Policy.
The Privacy Policy explains how we collect, use, store, and share personal data, including:
- account information
- profile information
- booking details
- content you upload
- information used for AI-assisted features
If there is any conflict between these Terms and the Privacy Policy on data handling, the Privacy Policy will apply to data matters.
15. Governing Law and Disputes
These Terms are governed by the laws of Uganda, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved in the courts of that jurisdiction, except where mandatory consumer protection or data protection law in your own country requires otherwise, in which case that local law will apply to the extent required.
This governs the contractual relationship between you and Engero. It is separate from the governing law of individual booking agreements between artists and clients, which is determined by the artist's country as specified in each booking agreement.
